There are many ways for successful individuals to legally enter the United States. Some professionals secure new jobs that allow them to qualify for visas. Others might look into domestic investment opportunities via the EB-5 visa.
The EB-5 immigrant investor visa allows foreign nationals to secure green cards after investing in domestic commercial enterprises. Since 1990, foreign nationals have been able to legally enter and live in the United States if they invest in an existing business or create a new business.
The investments must meet specific standards to qualify. What are the minimum requirements for those pursuing EB-5 visas?
Job creation or preservation are key factors
Those starting new businesses have to create full-time work opportunities for people in the United States. They cannot simply start a small professional practice where they are the only worker. Typically, EB-5 applicants must create at least 10 full-time positions.
Investors can also commit capital to troubled businesses already operating in the United States. They may then qualify for an EB-5 investor visa because they have preserved jobs that might otherwise disappear. If a company has struggled for at least two years and reported a net loss of at least 20% of its net worth, a foreign investor could qualify if they help that company maintain the number of existing employees for at least two years.
Minimum capital requirements
EB-5 visas also require a minimum amount of invested capital. Since March 15th, 2022, the standard minimum investment amount is $1,050,000.
However, those investing in a targeted employment area may be able to qualify for an EB-5 visa with a lower commitment of capital. Those investing in rural areas and regions with an unemployment rate that is at least 150% of the national average could qualify for an EB-5 visa with an investment of $800,000.
Not only can an EB-5 visa provide a legal opportunity to enter the country, but it can also provide opportunities for the immediate family members of the investor. Learning more about EB-5 visas and other ways to secure visas or green cards can be beneficial for those who want to move to the United States. Foreign nationals with significant resources can potentially convert those resources into an immigration opportunity.
